By accessing or using DirectWorldHolidays (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.
These Terms constitute a legal agreement between you ("User," "you," or "your") and DirectWorldHolidays ("we," "us," or "our"). Please also review our Privacy Policy, which describes how we handle your personal data.
2. About Our Service
DirectWorldHolidays is an online platform that enables users to search for, compare, and book accommodations worldwide. We act as an intermediary between you and accommodation providers ("Properties").
- We facilitate the booking process but are not a party to any agreement between you and the Property.
- The Property is solely responsible for delivering the accommodation and related services.
- We display information provided by Properties and strive for accuracy, but cannot guarantee that all details are complete or up to date.
- Availability, prices, and conditions shown on our Platform are subject to change without notice.
3. User Accounts
To access certain features of our Platform (such as saving favorites and submitting support requests), you must create an account.
- You must provide accurate, current, and complete registration information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be at least 16 years old to create an account.
- You are responsible for all activities that occur under your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Booking Process
When you make a booking through our Platform:
- You enter into a direct contractual relationship with the Property for the accommodation.
- You must provide accurate guest information, including names, number of guests, and dates of stay.
- A booking is confirmed once you receive a confirmation notification from the Property or our Platform.
- Booking confirmation details are sent to the email address associated with your account.
- It is your responsibility to verify the booking details and notify us of any errors promptly.
5. Prices and Payment
- Prices displayed on our Platform include applicable taxes unless otherwise stated.
- Prices are shown in your selected currency for convenience. The Property may charge in its local currency, and exchange rates may vary.
- Additional charges such as resort fees, parking, or service charges may apply and will be disclosed where possible.
- Payment timing and methods vary by Property. Details are provided during the booking process.
- We are not responsible for any fees charged by your bank or payment provider, including foreign transaction fees.
6. Cancellations and Refunds
- Cancellation policies are set by each Property and are displayed during the booking process.
- Free cancellation deadlines, where available, are clearly shown before you confirm your booking.
- Non-refundable bookings cannot be cancelled or modified without incurring the full cost.
- Refund amounts and timing depend on the Property's cancellation policy and payment method.
- If a Property cancels your booking, we will assist you in finding alternative accommodation or obtaining a refund.
- No-shows (failing to arrive without cancellation) are typically charged the full booking amount.
7. User Conduct
When using our Platform, you agree not to:
- Provide false or misleading information in your account or bookings.
- Use the Platform for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use automated tools (bots, scrapers) to access our Platform without permission.
- Submit fraudulent bookings or support requests.
- Harass, abuse, or harm other users or Property staff.
- Interfere with the proper functioning of the Platform.
8. Intellectual Property
All content on our Platform, including but not limited to text, graphics, logos, icons, images, and software, is the property of DirectWorldHolidays or its content suppliers and is protected by applicable intellectual property laws.
- You may not reproduce, distribute, modify, or create derivative works from any content without written permission.
- Property photos and descriptions are provided by accommodation partners and remain their intellectual property.
- The DirectWorldHolidays name and logo are trademarks and may not be used without authorization.
9. Limitation of Liability
- Our Platform is provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not guarantee the accuracy, completeness, or reliability of any information displayed on our Platform.
- We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of our Platform or any booking made through it.
- We are not responsible for the actions, omissions, or policies of accommodation providers.
- Our total liability to you shall not exceed the amount of any service fees paid by you to us in the 12 months preceding the claim.
10. Dispute Resolution
- Any disputes related to your accommodation should first be directed to the Property.
- If you are unable to resolve a dispute with the Property, contact us through our Help Center and we will endeavor to assist.
- These Terms shall be governed by and construed in accordance with applicable law.
- Any legal proceedings shall be brought in the courts of the applicable jurisdiction.
11. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the changes, you should stop using the Platform.
